General Terms and Conditions on the Provision of Electromobility Services (GTC)

Introduction

These General Terms and Conditions shall apply between SOCAR Energy Switzerland LLC (“SOCAR”) and the SOCAR Charge Customers, the users of the SOCAR Charge app, the SOCAR Charge website and the SOCAR Charge charging stations.

By registering for a charging service and using the SOCAR Charge app, the SOCAR Charge website or a SOCAR Charge charging station, the Customer confirms that he or she has understood and accepted these GTC.

SOCAR uses systems and services of MOVE Mobility SA for its services under these GTC.

Conclusion of contract, registration and customer account

Online registration results in the conclusion of a contract between SOCAR and the Customer. After the conclusion of the contract, a customer account is automatically opened for the Customer.

The conclusion of a contract entitles the Customer to use the charging services of SOCAR.

SOCAR has the right to refuse registration of a Customer without stating reasons.

The Customer is responsible for ensuring that the customer account is used as intended. He or she shall take appropriate measures to prevent unauthorised access by third parties. In the event of loss or theft of his or her customer account data, the Customer must report this immediately so that access to the SOCAR Charge network can be blocked. SOCAR disclaims all liability in the event of misuse of the customer account. Charging sessions conducted before the Customer's account was blocked shall be borne by the Customer.

The Customer has no right to reimbursement or compensation in the event of misuse of his or her customer account.

Use of charging stations

The SOCAR Charge network is intended exclusively for supplying electric vehicles with power. The Customer shall not under any circumstances have the right to resell the energy made available to him or her as part of the charging infrastructure of the SOCAR Charge network, and the Customer expressly undertakes not to do so.

To start the charging process, the Customer shall follow the information available at the respective charging point. The charging process can be started using the SOCAR Charge App and the customer account.

In the case of a private charging station, the Customer must first and foremost apply to the owner of the charging station for access to the station.

The Customer must comply with the applicable parking conditions and rules at the charging location and, unless otherwise specified, pay the parking fees.

The Customer has the obligation to report defective or damaged charging stations to SOCAR.

SOCAR does not guarantee that charging stations will be available and/or that the charging process will work flawlessly, and SOCAR disclaims any liability in this regard.

Prices

The prices for the use of the SOCAR Charge network shall be set by SOCAR. The prices may consist of a fixed base price for network access and/or a variable price depending on the use of the SOCAR Charge network and roaming partner networks.

The current prices for a given charging station can be viewed on the SOCAR Charge App. Prices may vary from charging station to charging station.

A monthly subscription fee is charged for managing the customer account.

The usage price includes the energy and the use of the charging infrastructure.

Billing and payment

The invoice amount shall be settled directly after each charge and/or renewal of the subscription using the payment method stored in the SOCAR Charge App.

SOCAR reserves the right to block customer accounts and to block charging sessions if debiting is not possible or invoices are not paid on time.

Duties of the Customer

The Customer shall independently take all necessary measures to prevent any damage to his or her vehicle(s) as a result of interruptions, irregularities or other malfunctions in the power grid.

The Customer shall be liable for losses incurred by SOCAR as a result of improper use of a charging station.

The Customer shall follow the instructions and precautions specified in the operating instructions and other instructions for use of the SOCAR Charge network. He or she shall strictly comply with the instructions in these documents and at the charging stations of the SOCAR Charge network.

SOCAR shall have the right to refuse to supply the Customer with electricity by blocking his or her SOCAR Charge customer account if the Customer conducts charging other than in accordance with the regulations or conducts charging that could otherwise pose risks to people or property or cause disruptions at charging stations. This shall also apply if the Customer obtains energy without authorisation, fails to pay invoices or fails to present a valid credit card for payment of his or her future energy consumption or if he or she seriously breaches his or her contractual obligations or fundamental terms and conditions in connection with his or her membership in the SOCAR Charge network.

Data protection

SOCAR uses the personal data collected or made available in compliance with the applicable statutory data protection provisions and ensures that its processors, including but not limited to MOVE Mobility SA (“Processors”), also do the same.

SOCAR and its Processors shall be entitled to use, store, process, evaluate and disclose the data to third parties if this is conducive to or necessary for the performance of the contractual relationship.

SOCAR and its Processors shall not collect any sensitive personal data as defined in the Swiss Data Protection Act. They shall take state-of-the-art measures to protect personal data.

SOCAR and its Processors shall only collect personal data that is necessary for the performance of the contractual relationship.

Customers have the right to request information about personal data at any time and to revoke the processing of personal data.

Obligations of SOCAR

Subject to mandatory statutory provisions, Customers have no entitlement to compensation for damage or losses arising directly or indirectly from the use of charging stations. This shall apply particularly in the event of interruptions or other irregularities or malfunctions in the power grid or in the event of restrictions, disconnections or restarting of network operation or supply, in the event of the interruption of the energy supply or in the event of the operation of centralised control systems.

SOCAR does not guarantee the availability of charging stations.

The Customer is not entitled to compensation for damage to the vehicle.

Contractual relationship and termination

The minimum contract term with SOCAR is one month.  The Agreement may be terminated at the end of the following month in the SOCAR Charge app.

Legal validity and order of precedence

If individual provisions of the GTC are legally invalid now or in the future, this shall not affect the legal validity of the remaining provisions hereof.

In the event of any inconsistency, incompatibility or discrepancy, the provisions of the individual contract shall take precedence over the provisions of the GTC.

Applicable law and jurisdiction

The applicable law is Swiss law. The place of jurisdiction shall be the registered office of SOCAR.

Entry into force and amendment of the GTC

The GTC may be amended by SOCAR at any time. The applicable version of the GTC and the technical instructions are available on SOCAR’s website.

Additional information for the use of the SOCAR Charge App:

A. Geolocation service

With the geolocation feature integrated into the SOCAR Charge App, nearby charging stations can be displayed on a map or in the form of a list.

B. Camera

To scan a charging station's QR code (Quick Response Code), access to the customer's camera is required. The data collected in this way gives the customer access to all relevant information about a particular charging point.
